Advice offered to those making claims over ice-related injuries
Posted by Mark Cunningham
Advice has been offered to people seeking to secure compensation over injuries they suffered as a result of the icy conditions currently affecting the UK.
Writing on AboutMyArea, Paula Cullen suggested that claimants must show that the accident and resulting injury were caused by someone else's negligence or by a breach of statutory duty.
If this is not proved, cases will not be able to progress, she pointed out.
According to the expert, the "obvious statutory duty" is set out in the Highways Act.
"In particular, a highway authority [is] under a duty to ensure, so far as is reasonably practicable, that safe passage along a highway is not endangered by snow or ice," she remarked.
Ms Cullen went on to state that accidents which occur on minor roads may be more difficult to claim for because local authorities have to prioritise maintaining major highways.
More snow has been forecast for some parts of the UK today and transport secretary Lord Adonis recently issued a warning that salt supplies would have to be rationed so that councils can cope with continuing icy weather.
