The divorce of Cheryl and Ashley Cole may prove to be expensive due to fact that the pair did not sign a pre-nuptial agreement before they entered into marriage.

Recently, it was revealed that the Girls Aloud singer and X-Factor judge and her footballer husband were to separate following intense media speculation on the subject.

Cheryl announced the development as she returned to the UK from a trip to the US.

While pre-nuptial agreements are not currently legally binding, a decision in the Court of Appeal in July last year ruled that they can carry a lot of weight, top divorce lawyer from Russell Jones & Walker Amanda McAlister noted.

She added: "With the press recently reporting high profile separations ... it's important to get expert legal advice in order to protect not only your assets but also your income."

The expert went on to state that certain elements need to be met before a pre-nuptial agreement can be considered binding.

For example, it must be fair and the arrangement must be entered into at least three weeks prior to the marriage.
