Landlord ordered to repay rent to tenants
A landlord in Nottingham has been ordered to repay rent to tenants, according to the local authority.
Barrington Oliver-Mighten failed to apply for a house of multiple occupation (HMO) licence.
Such licenses apply to large privately rented houses of multiple occupation and landlords and letting agents who fail to get them can face fines of up to £20,000 and a criminal record.
During a recent court hearing in Nottingham, Mr Oliver-Mighten was fined £5,967.82.
In addition, his tenants brought a case to the Residential Property Tribunal service to recover the rent they paid and the tribunal ruled that he should pay them £2,640.
Councillor Alan Clark, portfolio holder for neighbourhood regeneration at Nottingham city council, said: "With the present state of the housing market many sellers may choose to rent their property while they wait for the market to recover.
"If they do so it is important that they are aware of all of their responsibilities and do not fall foul of the courts."
