Legal battle to overrule will proves successful
A university lecturer from North Yorkshire has been successful in having the terms of the will left by her parents overruled.
Christine Gill worked on the farm owned by her family in her spare time over a period of thirty years and, following the death of her father a decade ago, she was given repeated reassurances by her mother that she would inherit the estate.
However, after her mother died three years ago, she discovered that the Potto Carr farm had been left to animal charity the RSPCA instead.
She argued that her father coerced his wife into making a will that went against her wishes.
Recently, Judge James Allen QC ruled that this was indeed the case and said that the father had used his spouse's fear of his temper and her anxiety to force her to agree to the terms of the document.
The RSPCA - which aims to promote kindness and prevent cruelty to animals and to alleviate their suffering - has revealed it intends to appeal the decision.
