Workplace discrimination victims 'may be set for increased payouts'

Ylr-news-19408944

As a result of a recent ruling by the Employment Appeal Tribunal (EAT), some victims of workplace discrimination may be in line to receive bigger payouts.

The bands of damages were raised by the tribunal, meaning that the top awards for those claiming injury to feelings can now be as high as £30,000.

This is up from the previous limit of £25,000.

In addition, the middle and bottom bands have increased to £18,000 and £6,000 respectively from previous boundaries of £15,000 and £5,000.

Introduced by the Court of Appeal, the three band system was established in 2002.

The changes implemented by the EAT - which serves to hear appeals from decisions made by employment tribunals - are part of an effort to get tribunals to use the three band system of awards with greater consistency.

Currently headed by Mr Justice Underhill, the EAT conducts hearings with either one judge present or one judge alongside two lay members.
